General Terms and Conditions of Sale
White Crane Qi Gong School Belgium
These general terms and conditions of sale set out the terms applicable to the Qi Gong classes and the heart coherence program offered by Tancho srl, under the brand White Crane Qi Gong School Belgium, hereinafter "the teacher". The contact person is Mr. Marc De Hertogh, principal instructor.
1. Purpose
The purpose of these general terms and conditions of sale is to define the conditions under which the teacher offers Qi Gong classes and the heart coherence program to participants.
The classes are given in a context of wellbeing, gentle physical practice and personal development. They do not, under any circumstances, constitute a medical, paramedical or therapeutic act.
2. Booking and participation
Participation in the classes does not require prior booking, unless otherwise indicated by the teacher on a case-by-case basis.
Participants may attend a class freely, subject to available spaces and the announced schedule.
The heart coherence program takes place in a very small group, on set dates and times which cannot be changed.
3. Rates and payment terms
The rates applicable to the classes are as follows:

Single class: €12.50 per session, payable by the end of the class at the latest

Card of 5 classes: €50, personal and valid for 3 months from the date of purchase, to be bought at the end of a class

5-class Duo package: €75, personal to 2 people, usable only when both people are present at the same class, and valid for 3 months from the date of purchase, to be bought at the end of a class
The price of the heart coherence program depends on the number of participants and is confirmed upon registration of the participant(s). Payment is made in full at registration.
Payment is preferably made:

By bank transfer via QR code on mobile phone; or
-
By bank transfer to the account of Tancho srl, IBAN BE70 3632 2380 6625, with the reference "First name and surname" and "Qi Gong class" or "Heart coherence program".
Any other payment method accepted by the teacher on a case-by-case basis remains at the teacher's discretion.
4. Validity of the class card
The 5-class card is strictly personal and non-transferable. It may not be assigned, resold, or used by another person.
It is valid for a period of 3 months from the date of purchase. Once this period has expired, unused classes are lost, except by exceptional agreement of the teacher.
5. Cancellation, absence and interruption of a class or session
No refund is due in the event of a participant's absence from a class, or from a session of the heart coherence program.
Classes not attended under a 5-class card remain usable during the card's period of validity, i.e. 3 months from the date of purchase. After this period, unused sessions cannot be refunded.
The teacher reserves the right to exceptionally cancel, postpone or modify a class or session in the event of unavailability, force majeure, illness, or circumstances beyond the teacher's control. In such cases, participants will be informed as soon as possible and, where applicable, the card's period of validity may be extended if necessary.
For the heart coherence program, any cancellation of a session by the teacher will be replaced by a new session.
6. Health, fitness and personal responsibility of the participant
The practice of Qi Gong, Tai Chi Chuan and heart coherence requires only a good general state of health and respect for the limits of one's own body.
However, participants are advised to seek their doctor's opinion before beginning the practice if they suffer from a particular condition, have a joint prosthesis or a pacemaker, have any medical condition that may affect their practice, or have any doubts about their state of health.
The meditative dimension of the class — particularly through the mental release it may induce — may also be uncomfortable for people going through a period of significant psychological distress or receiving psychiatric care. In such cases, prior medical advice is strongly recommended.
Each participant undertakes to practise in accordance with their own abilities, limits and current state of health. It is their responsibility to inform the teacher — before the start of the class — of any pain, significant fatigue, injury or particular health issue, or any specific situation that might require an adaptation of the practice.
7. Liability
The teacher holds professional civil liability insurance covering the organization of the classes.
The teacher uses all reasonable means to provide a serious, respectful and safe practice environment.
However, the participant remains solely responsible for their participation in the classes, their state of health, their physical or psychological limitations, and their use of the exercises offered.
The teacher cannot be held liable for:

an incident, injury or discomfort resulting from the participant's failure to respect their own physical limits or the recommendations given during class

the absence of prior medical consultation where this was necessary given the participant's state of health
-
the loss, theft or damage of personal belongings brought to the class venue
The teacher's liability may only be engaged in the event of gross or intentional misconduct in the organization or supervision of the classes, within the limits provided by applicable law.
8. Respect for the class framework
Participation in the classes implies respect for the framework set by the teacher, particularly regarding punctuality, calm, respect for other participants, and attentiveness to one's own body.
The teacher reserves the right to refuse or interrupt the participation of a person whose behavior would harm the proper conduct of the class, safety, calm, or respect within the group (including the teacher), without this giving rise to any refund.
9. Intellectual property
Unless otherwise stated, the content, materials, texts, visuals or exercises that may be shared by the teacher as part of their activity, as well as the videos and materials available on the website www.whitecraneqigong.be, remain the teacher's exclusive property.
They may not be reproduced, distributed, modified, or used for commercial purposes without the teacher's prior written authorization.
10. Applicable law and disputes
These general terms and conditions of sale are governed by Belgian law.
In the event of a dispute, the parties undertake to seek an amicable solution as a priority.
Failing an amicable agreement, the courts of the judicial district of Brussels shall have sole jurisdiction, unless otherwise required by mandatory legal provision.
11. Acceptance
Participation in the Qi Gong classes, Tai Chi Chuan classes, or the heart coherence program constitutes full and unconditional acceptance of these general terms and conditions of sale.
